CAG report in action

In response to the Comptroller and Auditor General (CAG)?s report and Telecom Regulatory Authority of India (TRAI)?s recommendation on the 2G scam issue (charging several operators for fraudulently acquiring new licenses, charging the government for issuing licenses and spectrum at a throw-away price, failure of many operators to meet the rollout obligation) of cancelling licenses, the Department of Telecommunications (DoT) has decided to issue show cause notices to - (a) 85 new licensees on account of their ineligibility to apply for the same on account of various reasons ranging from not meeting net worth criterion to submitting fictitious documents to avail the license (b) 119 licensees (81 of which overlap with the above 85 licensees) for their inability to meet the rollout obligation.

•85 new licenses stand the risk of cancellation?Of the total of 122 licenses granted by the DoT in 2008, 85 new licenses would be issued a show cause notice demanding reasons as to why their licenses should not be cancelled, as the said operators were found to be ineligible for the licenses in the first place on account of issues ranging from non fulfillment of the adequate net worth criterion, submission of fictitious documents and lack of mention of telecom line of business in their memorandum of association. The DoT would provide them a time frame of 60 days to respond on the same, post which the reasoning would be studied by the ministry. If not satisfied, it would lead to cancellation of the licenses.
•119 licenses likely to face financial penalty for poor rollout?Another set of show cause notice would be sent to 119 licenses (81 of which overlap with the first form of show cause notice as well) for not meeting the roll out obligations. The minister has also said that it will claim financial damages from these licenses, and further one year time frame would be provided for them to meet the rollout obligations. In case the respective licensees do not meet their roll out obligations within one year, the licenses are likely to be cancelled.
•Swan?s case handed over to the Ministry of Corporate Affairs?As regards the issue of Swan Telecom (now Etisalat DB Telecom), the minister has said that the issue will be investigated by the Ministry of Corporate Affairs, given that there are allegations that the company was acting as a front for Reliance Communications (RCOM). The Corporate Affairs Ministry will also study the capital structure of Swan and any cases of the company acting as a front will be investigated.
